1. Document Status
These Terms of Service (the "Terms") govern use of the AI Content Zavod service available at aicontentzavod.tech, including the website, user account, APIs, payment features, integrations, generation tools, and content publishing workflows (the "Service").

The user accepts these Terms by registering, logging in, making a payment, connecting an integration, uploading materials, using Service features, or otherwise using the Service. If the user does not agree, they must stop using the Service.
These Terms apply together with the Personal Data Processing Policy. Personal data processing is governed by the Policy available at /privacy/en.
2. Definitions
- Service means the AI Content Zavod software suite for preparing, generating, editing, scheduling, publishing, and analyzing short-form video content and related materials.
- User means a person using the Service, including an individual entrepreneur, a company representative, or an individual aged 18 or older.
- Account means the user's Service account used to access projects, payments, integrations, and generated results.
- Content means any materials uploaded, created, generated, edited, stored, or published through the Service, including texts, scripts, prompts, images, audio, video, covers, metadata, descriptions, and hashtags.
- Integrations mean external platforms and services, including YouTube/Google Business Profile, TikTok, Meta* (Instagram*/Facebook*), Pinterest, Upload-Post, and other services available in the interface.

3. Subject Matter
The contractor provides access to the Service as a software tool. The Service helps automate content preparation and publishing but is not an editorial office, advertising agency, legal adviser, promotion guarantor, representative of external platforms, or party to the user's relationship with social networks.
The Service may include generation of scripts, video, images, voice audio, metadata, stock material selection, publishing schedules, autopublishing, publication statuses and analytics, project management, internal wallet balance, and other features. The current feature set is determined by the live version of the Service and may change.
The user understands that some features depend on external APIs and services. Their availability, speed, rules, limits, moderation, and technical changes are not fully controlled by the contractor.
4. Account and Access
To use the personal account area, the user creates an account and provides accurate information. The user is responsible for securing their email, password, device, session tokens, and connected external accounts.
Actions performed through the user's account are deemed performed by the user unless the user proves that access was obtained by third parties without the user's fault. If compromise is suspected, the user must promptly change the password, disconnect suspicious integrations, and notify the contractor.
The contractor may temporarily restrict access to the account or specific features if there are signs of a security breach, abuse, unauthorized access, breach of these Terms, legal violation, or violation of external platform rules.
5. Integrations and Publishing
By connecting an external platform, the user confirms that they are entitled to manage the relevant account, page, channel, board, or profile and may grant the necessary permissions to the Service.
The user independently chooses which integrations to connect and which actions to perform through the Service. The Service publishes content, obtains statuses, and retrieves analytics within the technical permissions granted by the user and the capabilities of the relevant platform.
The contractor does not guarantee that a publication will be accepted, preserved, shown to an audience, monetized, recommended by algorithms, or not restricted by an external platform. External platforms may remove content, block accounts, change APIs, impose limits, require additional verification, or reject publication.
Use of references to, and integrations with, Meta* (Instagram*/Facebook*) does not mean endorsement of Meta Platforms Inc. or an invitation to violate Russian law.

6. User Content
The user retains rights to source content uploaded to the Service and grants the contractor a limited, non-exclusive, royalty-free right to use such content only as required for Service operation: store, copy, process, convert formats, analyze, generate derivative materials, publish through connected accounts, and transfer to providers involved in service delivery.
The user warrants that they have all rights and permissions required to upload, process, generate, edit, and publish content, including rights to images of people, voice, music, trademarks, logos, video materials, texts, databases, advertising claims, and third-party personal data.
The contractor is not required to pre-check the user's content, the legality of source materials, the accuracy of advertising claims, or compliance with external platform rules. The user must review AI outputs and final publications before posting.
7. AI Outputs and No Result Guarantee
The Service uses automated and AI tools, including third-party models and services. Generated content may be inaccurate, incomplete, similar to other users' results, contain mistakes, factual inaccuracies, undesirable wording, or elements requiring additional review.
The contractor does not guarantee uniqueness, commercial effect, legality, advertising performance, fitness for the user's expectations, absence of third-party claims, or successful moderation by external platforms for AI outputs.
The user independently decides whether to publish and is responsible for reviewing legal, factual, advertising, ethical, and platform suitability of the final result.
8. Prohibited Use
The user must not:
- violate Russian law, third-party rights, or external platform rules;
- upload or publish illegal, extremist, terrorist, fraudulent, defamatory, discriminatory, or otherwise unlawful content;
- use the Service for spam, phishing, user deception, illegal advertising, or bypassing external platform restrictions;
- publish third-party personal data without a lawful basis;
- infringe copyright, neighboring rights, exclusive rights, trademarks, image rights, or trade secrets;
- attempt unauthorized access to the Service, accounts, infrastructure, or data;
- interfere with Service operation, make excessive automated requests, or bypass limits, security mechanisms, or billing;
- transfer the account to third parties without the contractor's consent where this creates a security or compliance risk.
If this section is violated, the contractor may restrict access, stop publications, delete disputed materials, refuse service, preserve necessary evidence, and seek protection of its rights.
9. Payments, Wallet, and Debits
The Service may be provided on a paid basis. Prices for functions, operations, generations, publications, integration profile maintenance, top-ups, and other services are shown in the interface, tariffs, notices, or related sections before the relevant action where technically applicable.
Top-ups are credited to the user's internal wallet balance. Debits are made when a paid operation is performed, a paid task is created, a paid function is connected or maintained, or in other cases described in the Service interface. Operation history is displayed in the account area or recorded in Service accounting systems.
Payments are processed by T-Bank. The contractor does not store bank card details. If the user enables auto top-up or saved payment functionality, the payment identifier and related technical data are processed to support that feature through the payment provider.
If an operation has already been delivered, generated, published, sent to an external service, or caused contractor expenses, the relevant debit may be non-refundable unless otherwise required by law or expressly stated in the interface. Requests for return of unused balance are reviewed considering delivered services, payment system fees, bonuses, technical errors, and legal requirements.
The contractor may correct obvious technical errors in balances, credits, debits, and payment statuses caused by failure, provider delay, duplicate operation, or incorrect synchronization.
10. Infrastructure and External Services
The primary database and file storage are organized through REG.RU / Reg.Cloud: a cloud PostgreSQL database and S3-compatible object storage in the Russian Federation. Frontend and backend code may run on a LightNode VPS in Germany, which means HTTP requests and runtime logs are technically processed on that infrastructure.
The Service uses external APIs and providers, including AI, voice, stock material, publishing, analytics, payment, and social platform providers. The contractor may change providers, processing routes, infrastructure, and technical architecture when needed for operation, security, quality, cost, or Service development. Current data processing information is disclosed in the Personal Data Processing Policy.
11. Availability and Maintenance
The Service is provided "as is" and "as available". The contractor seeks to maintain operability but does not guarantee continuous, error-free, or uninterrupted operation, absence of data loss, compatibility with every device, or unchanged features.
The contractor may perform preventive, emergency, and scheduled maintenance and may change features, interface, tariffs, limits, APIs, generation logic, and publishing logic. Where feasible, material changes are communicated through the interface, email, or updated documents.
12. Liability
The user is responsible for legality of source and published content, rights to materials, correctness of prompts, accuracy of information, compliance with external platform rules, security of account access, and consequences of publications.
The contractor is responsible for providing access to the Service within the paid and available features where a violation is caused by the contractor's fault. The contractor is not liable for external platform actions, payment providers, AI providers, hosting, network operators, blocking, moderation, API changes, Internet failures, user actions, or third-party actions.
To the maximum extent permitted by law, the contractor's liability is limited to the amount actually paid by the user for the disputed function or operation during the period in which the liability arose. This limitation does not apply where mandatory law prohibits it.
13. Personal Data
Personal data is processed under the Personal Data Processing Policy. The user confirms that they have read the Policy and understand the data categories, purposes, cookie use, possible cross-border transfers, and transfers to external services.
If the user uploads third-party personal data or materials identifying third parties, the user confirms having a lawful basis for such transfer and processing and assumes responsibility for compliance with personal data law.
14. Term and Termination
These Terms apply from acceptance until the user stops using the Service, the account is deleted, or the Terms are replaced by a new version.
The user may stop using the Service and request account or data deletion at martsinyuk.pl@gmail.com. The contractor may retain certain data where required for law, accounting, tax records, payments, dispute resolution, security, or confirmation of delivered services.
The contractor may terminate or restrict access if the user violates the Terms, law, third-party rights, external platform rules, payment obligations, or creates abuse or security risks.
15. Changes
The contractor may amend these Terms. The new version takes effect upon publication on this page unless stated otherwise. Continued use of the Service after publication means acceptance of the updated Terms.
If the user does not agree with the new version, they must stop using the Service and may contact the contractor regarding remaining balance or data deletion under these Terms and the Policy.
16. Governing Law and Disputes
These Terms are governed by the laws of the Russian Federation. Claims and legally significant notices are sent to martsinyuk.pl@gmail.com. The parties seek to resolve disputes through negotiations and exchange of claims.
If no settlement is reached, the dispute is submitted to a court under the applicable procedural laws of the Russian Federation. If mandatory law grants the user another procedure or venue, those mandatory rules apply.
